Cancellation & Refund Policy

1. Overview
At Samudr Softwares ("Samudr AI," "we," "us," or "our"), we strive to deliver high-quality enterprise AI solutions. This Cancellation & Refund Policy outlines the terms under which engagements may be cancelled and refunds may be issued.
Since our services are customized B2B AI solutions (including AI voice agents, inference platforms, automation tools, and consulting), each engagement is tailored to the Client's specific requirements. Please review this policy carefully before making a payment.
2. Cancellation Policy
2.1 Before Work Commences
If you wish to cancel an engagement before any work has commenced and no resources have been allocated, you may request a full cancellation by emailing us at [email protected]. A full refund of any advance payment will be processed in this case.
2.2 After Work Has Commenced
Once work has begun on a project or engagement:
- The Client may cancel with 30 days' written notice (or as specified in the Agreement/SOW).
- The Client shall be invoiced for all work completed up to the cancellation date, including any committed third-party costs.
- Any unused portion of pre-paid fees, after deducting charges for work completed, will be refunded within 15 business days.
2.3 Subscription/Retainer Services
For ongoing subscription or retainer-based services:
- Cancellation requests must be submitted at least 30 days before the next billing cycle.
- Services will continue until the end of the current paid period.
- No pro-rated refunds will be issued for the remaining days of a current billing period, unless otherwise agreed.
3. Refund Policy
3.1 Eligibility for Refund
Refunds may be issued in the following cases:
- Cancellation before work starts: Full refund of any advance payment.
- Service not delivered: If Samudr AI fails to deliver agreed services within the stipulated timeline (and the delay is not caused by the Client), a proportional refund will be issued.
- Duplicate payment: Accidental duplicate payments will be refunded in full.
- Mutual agreement: Refunds may be negotiated on a case-by-case basis for partially completed work.
3.2 Non-Refundable Scenarios
Refunds will not be provided in the following cases:
- Work that has been completed and delivered as per the agreed scope.
- Dissatisfaction arising from changes in the Client's requirements after delivery.
- Delays caused by the Client's failure to provide required data, access, or feedback.
- Third-party costs (cloud infrastructure, API usage, software licenses) already incurred on behalf of the Client.
- Consultation fees for completed discovery or strategy sessions.
4. Refund Process
- To request a refund, email us at [email protected] with your project details, invoice number, and reason for the request.
- Refund requests will be reviewed within 5 business days.
- Approved refunds will be processed within 15 business days to the original payment method.
- For payments made via bank transfer or UPI, refunds will be credited to the same account. For card payments, refunds will be processed through the payment gateway.
5. Dispute Resolution
If you are dissatisfied with a refund decision, you may escalate the matter by writing to us at [email protected]. We will make every reasonable effort to resolve disputes amicably. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
6. Modifications to This Policy
We reserve the right to update this Cancellation & Refund Policy at any time. Changes will be posted on this page with a revised "Last updated" date. For active engagements, material changes will be communicated directly to the Client.
